Given recent developments and a fast-evolving landscape, employment attorneys on the defense and plaintiff sides are grappling with increasingly complex issues related to the enforcement of arbitration agreements and, once in arbitration, the unique aspects of arbitration proceedings. With a focus on practical guidance and drawing from their own experiences, the speakers will discuss arbitration essentials for the California employment attorney, with insights about how future trends may impact strategy decisions and client advice.
Topics
- Enforceability of arbitration agreements, including moving to compel and opposing motions to compel arbitration
- Considerations for arbitration agreements governed by the Federal Arbitration Act (FAA) versus the California Arbitration Act (CAA)
- A compare-and-contrast overview on proceedings in arbitration versus in court, including practical guidance specific to arbitration
- Insights about trends and the future of arbitration, including PAGA-related issues, Ending Forced Arbitration of Sexual Assault & Sexual Harassment Act, and federal preemption of state arbitration laws
