Family Law Parenting Cases, Abuse, and Gun Violence: What We Can Do
||October 14, 2021
||12:00 - 1:15 p.m.
| Beverly Upton
San Francisco Domestic Violence Consortium
Too many family law conflicts not identified as “domestic violence matters” include elements of power and control, abuse, harassment, manipulation, threats, mental health concerns, and risks to the adults, children, and professionals involved. When these characteristics are combined with access to firearms, the possibility of severe injury and lethal outcomes increases. During this facilitated conversation, we will discuss current research, the legal landscape in California, and promising practices for prevention, including screening questions, information to provide clients and litigants, and examples of parenting plan language to decrease risk and increase safety for families.
• Discussion of relevant Family Code sections and rules of court addressing domestic violence, child custody, and firearms
• Why “high conflict” description can obfuscate serious risk for clients, children, attorneys, and the court
• Key steps family law attorneys and the court can take to decrease risk
• Information on additional resources available to assist with safety planning and compliance with firearms prohibitions
Audience: Attorneys, judges, court staff, victim/survivor advocates, gun violence prevention advocates, policymakers, law enforcement, supervised visitation providers, social workers, mediators, mental health practitioners.
