This program highlights the differences between state and federal civil practice and is intended to help practitioners familiar with federal court. Learn about common mistakes to avoid in state court and procedures they can take advantage of in state court. For example, when practicing in state court, a practitioner should be aware of the different limits on discovery both in terms of quantity and scope. Likewise, one should be aware of the different standards for expert witness disclosures and summary judgment, the timing for such motions, and other distinctions.

State court also offers certain procedures not available in federal court, for example, peremptory disqualification of a judge one time. If you’re looking to learn what mistakes to avoid by assuming state and federal practice are the same — and what unique tools you can take advantage of in state court, this program is for you.
