Panel I: Patent Litigation
This panel, featuring distinguished patent attorneys and an AI startup founder, will cover two sets of topics. The first topic covers recent developments and practice pointers relating to prosecution and litigation of patents on AI inventions. This will include a discussion of the U.S. Patent Office’s guidance and requests for comments on issues such as (1) AI as an inventor or disclosure of AI’s contribution to the invention process; (2) section 101 patent-eligibility practice; and (3) obviousness and the definition of a person of ordinary skill. The second topic is a discussion of AI-enhanced tools that law firms can use, both for the practice of patent litigation, prosecution, and transactions. The presentation will also cover leveraging AI to help with non-billable tasks, including helping legal marketing teams effectively showcase their attorneys' experience to drive overall business growth.
Topics
- The recent, substantial increase in the number of AI patented inventions and its impact on patent prosecution and litigation
- The panel’s experience and tips on prosecuting AI-related patents and litigation disputes over such patents
- Review of the U.S. Patent Office’s guidance and requests for comment on AI’s implications, including: (1) AI as an inventor or disclosure of AI’s contribution to the invention process; (2) section 101 practice; and (3) obviousness and the definition of a person of ordinary skill
- Use of patents versus trade secrets to protect intellectual property on AI
- AI tools for patent practitioners
- AI tools for law firms, including for marketing.

Topics
- Music/voice likeness rights in the age of AI

Panel III: Why "Generative AI is Doomed"
Introduction
Jeffrey Thayer, Lewis Brisbois Bisgaard & Smith
Keynote Speaker
 |
Eric Goldman
Professor of Law and
Co-Director
High Tech Law Institute
Santa Clara University
School of Law |
Professor Goldman will present his controversial thesis as to why ‘Generative AI is Doomed.’ He will present a contrarian stance about the direction that regulation of AI is heading. Technological innovation flourishes only within a thoughtfully designed legal infrastructure, and his talk will explain why pro-regulation advocates are likely to overshoot their mark (unless they intend to kill Generative AI outright, which may be the agenda of some).”
5:00 - 7:00 p.m. | Networking Mixer
The educational portion of our program will be followed by a can’t miss-networking event at the beautiful new BASF facilities! This will be a great opportunity to meet and discuss with Professor Goldman, the other panelists, Intellectual Property Section Executive Committee Members, and many other top legal professionals in a classy and comfortable setting.
