Trials present many challenges. Some often overlooked but critical strategic considerations include effectively making and opposing motions during trial including motions for nonsuit and for judgment, motions for directed verdict, motions to amend to conform to pleadings and motions for mistrial. And if your trial does not go as planned and you are considering appeal, be aware that California’s posttrial motions for new trial and judgment notwithstanding the verdict (JNOV) may be available to save your client the expense, uncertainty and protracted delays inherent in appeals. However, posttrial motions require strict adherence to a complex set of procedures. This program will provide an overview of these procedures, competing considerations and practice pointers for trial attorneys.

Topics

  • Motions to consider making during trial
  • Responding to trial motions
  • Procedural and evidentiary hurdles for making posttrial motions
  • Responding to posttrial motions
