What Every Employment Lawyer Should Know about Whistleblower-Reward Programs
(Rebroadcast)

Date Thursday, June 5, 2025
MCLE Registration 11:30 a.m. - 12:00 p.m.
Virtual Program 12:00 - 1:00 p.m.
MCLE 1 Hour

Whistleblower-reward programs, which include laws like the False Claims Act (FCA) and “tip” programs run by several federal agencies, offer significant financial incentives to employees who report fraud and other unlawful conduct within their organizations. Employee representatives often encounter clients with strong whistleblower-reward claims, but assessing those claims and navigating these complex programs can be challenging. Counsel for employers may defend against such claims and advise clients on internal compliance efforts to address employee concerns before they are reported externally. Panelists who represent both whistleblowers and employers will provide an overview of these reward programs and discuss practical issues that come up in litigation in this specialized area. The discussion will focus on aspects that employment lawyers should be especially attuned to, including anti-retaliation provisions that protect individuals who come forward, the enforceability to releases in post-employment agreements, and best practices for compliance programs.
