Representing SIJ clients in removal proceedings is a challenging process that requires a balancing act between legal relief in family or probate court and the immigration court. Now that the current Trump administration has posed additional challenges, this webinar will discuss representation in custody and guardianship cases while bearing in mind issues to be addressed at the immigration court. The topics that will be discussed include SIJS eligibility based on abandonment/neglect/abuse, asylum evidence relevant to SIJS proceedings; family and probate proceedings in San Francisco, USCIS I-360 updates and deferred action, challenging the NTA and improper service in immigration court, seeking continuances, admin closure, and termination during removal proceedings, risk of expedited removal, post IJ removal order strategies, and how JOP class membership may overlap both SIJ and removal proceedings.
Topics
- SIJS eligibility and proceedings
- USCIS I-360 Process
- Providing SIJS case status updates to the Immigration Judge
- Challenging NTA and DHS evidence of removability
- Maintenance of removal proceedings and post IJ Removal Order
- JOP Class members
